State of Nevada Dept. of Transportation v. Bedrock, LLC (2007)

The State widened State Route 160 (Blue Diamond Road) in the southwest area of Las Vegas which required the condemnation of several unique businesses.

Our client owned and operated a specialized landscaping company which focused in the sale and delivery of landscaping rock that is widely used in the desert southwest. The State was required under the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 to assist in and relocate our client’s business.

Our office demonstrated to the State the unique attributes of our client’s business which included unique access requirements, unique separation requirements, and unique fixtures required by this type of business. The State was unable to find a suitable site to relocate our client’s unique business and paid our client $5,000,000 where the State had originally offered $2,500,000.
